Richard is a Partner in the Commercial Litigation department having joined JMW in February 2013 as a specialist property litigator. He deals with all matters relating to both commercial and residential property disputes including:
- Commercial landlord and tenant, including dilapidations, breach of covenant, lease renewals, assignments/underletting and forfeiture
- Block management/long leasehold landlord and tenant
- Building Safety Act
- Lease extensions, collective enfranchisement and Section 5 - Right of First Refusal
- The Trusts of Land and Appointment of Trustees Act 1996 claims
- Proprietary estoppel disputes
- Easements including prescriptive easements
- Boundary disputes
- Adverse possession claims
- Restrictive covenants relating to property
- Vesting order applications
- Professional negligence relating to property transactions and surveyor valuations
- Rectification and title disputes
- Property contract disputes, sale and purchase, options, lock outs and overage
Richard’s client base consists of companies and individuals who operate as landlords, managing agents, lettings agents, providers of social housing, tenants, tenants’ associations and RTM companies.
Richard takes a pro-active and commercially sensitive approach to litigation, recognising that often the best result for the client is one which achieves their objectives with minimum cost and stress. He is also an astute commercial litigator and is often instructed in breach of contract and other general commercial disputes.
