Successful defence of an Inheritance Act claim

Claire Brierley has assisted an executor and beneficiary to robustly defend an Inheritance Act claim and secure the claimant’s withdrawal of any claims against the estate at the initial stages of the claim. The Claimant sent a letter of claim suggesting he had a claim under the Inheritance (Provision for Family and Dependants) Act 1975, a proprietary estoppel claim and a constructive trust claim. The Claimant suggested he was entitled to sums from the estate and proposed he be granted a life interest in the Deceased’s property. Such claims/interests were not in line with the Deceased’s last will which was clear as to who was inherit his property and assets. The letter of claim was lacking in detail and Claire advised her client to reply robustly highlighting the requirements of a compliant letter of claim and the failings of the Claimant’s purported claims. The Claimant’s solicitors conceded and confirmed by return their client had withdrawn all claims against the estate.
