JMW successfully defend breach of contract because of the Claimant’s procedural failure
JMW acted for the defendant in a breach of contract claim. The defendant had been accused by the claimant of breaching a licence agreement for failure to pay invoices that arose from the defendant renting an office space. There was a personal guarantee attached to the Licence Agreement, allegedly, so the claimant was bringing a claim directly against the defendant for breach of contract.

JMW were able to put forward a robust defence for our client. We also advised and managed the client’s expectations, and were able to assist, in relation to this being a small claims matter and prepared the documentation for trial.
Outcome
After JMW’s team prepared our client for trial, we received a court order that the claimant had failed to pay the trial fee by the specified date and as such the claim was struck out. Not only did JMW protect the client’s position by fully preparing for trial when the circumstances were uncertain, but we also were able to assist up to the point of trial and the claim being struck out.
