Gross Misconduct – No Case to Answer
Andrew Gilligan successfully represented a police officer who faced a single allegation of Gross Misconduct. Following various written representations being made to Lancashire Police, it was decided that there was no case to answer and formal proceedings were officially withdrawn against the individual.
It was alleged that the individual had consumed various alcoholic drinks and had been intoxicated throughout the day and then driven his vehicle. It was alleged that the police officer had breached the Standard of Professional Behaviour in respect of Discreditable Conduct. Following instructions being taken from the individual, Mr Gilligan was able to prove that the individual did drive on the dates in question, but he was not driving whilst intoxicated therefore there was no breach. Following careful analysis of bank statements and the client’s recollection, Mr Gilligan submitted multiple written representations to avoid any proceedings taking place based on the individual’s credibility.
