Successful settlement for Inheritance Act claim
Claire Brierley successful assisted her client settle his Inheritance Act claim against his late father’s estate. The Deceased was sadly diagnosed with a terminal degenerative condition. The Deceased had three children, one of whom was a minor and was provided for by way of the Deceased’s work pension. Whilst steps had been taken by the Deceased to prepare a will and set up a trust for his two children who were young adults he sadly didn’t sign the will before his death. The rules of intestacy meant the Deceased’s wife (who was not the mum of any of Deceased’s children) was to inherit his full estate whilst also receiving his pension and additional payments for her minor son. The Deceased’s diagnosis and death understandably had a significant impact on our client to the extent that he was unable to complete his further education. Despite a robust defence at mediation we were able to secure our client a lump sum payment for his future education and needs in addition to securing possession of a very sentimental item that the defendant had until then refused to give up.
