The Case

Mr W was descending the stairs at a hotel and slipped and fell when he stepped down onto the floor of the foyer. He did not realise the floor had been freshly mopped, and there was no visible wet floor sign or warning at the scene prior to his slip. Mr K sustained injuries to his knee and back and reported the accident to the hotel manager. 

The Claim

The defendants denied liability on the basis that a wet floor sign would have been visible to Mr K. We obtained statements from Mr K’s family who were with him at the time which confirmed no wet floor sign was visible, and we obtained expert evidence from a Local Standards expert and orthopaedic expert. 

Final Settlement

The defendants maintained their stance and made no offers, so we pursued the case and made our preparations for trial. The day before the trial, the defendants made an offer to settle the case, and this was accepted by Mr K.
