6 Month Disqualification Avoided – Totting Up - Exceptional Hardship Successful
Hojol Uddin, Helen Kelsall and Charles Stansfield successfully represented Mr. M, a business owner at risk of a disqualification for exceeding the speed limit under “totting up” provisions. This client had previously received endorsements for penalty points on a number of occasions and, receiving this additional offence placed him at risk of a minimum 6-month disqualification.
Mr M entered a guilty plea to obtain maximum credit for the sentence which would be imposed against him. This was supported by strong mitigation by advancing an application for exceptional hardship, to avoid the minimum totting up disqualification.
The Magistrates Court having heard the mitigation and representation put forward by JMW Solicitors, found that there was exceptional hardship should Mr M receive a disqualification from driving. The Court therefore imposed a fine and four penalty points against Mr M but importantly, not a disqualification from driving.
