Hojol Uddin and Elisha Kaur successfully represented Mr. S who was at risk of a lengthy disqualification period following charges of excessive speed and failure to provide information. Mr S was at risk of becoming a “totter” due to previous speeding offences, therefore he instructed Hojol Uddin at JMW Solicitors to prepare and mitigate on his behalf.

Mr S instructed that he required his licence to drive as his business and family would suffer difficulties should he lose his license. Mr S was advised in advance of the hearing that he would likely be called to give evidence at the hearing to explain the hardship which would be suffered by all those who rely upon him, and his ability to drive. Whilst at the hearing, Mr S was questioned to the effect that what he had presented to the Court was “manageable hardship” but Mr S explained that the only method of transport should he lose, his license would be either taxis or public transport but this would place a large personal and financial burden on his family members who have considerable responsibilities themselves.

Upon hearing this evidence, the lay bench returned an imposed a disqualification of 2 months, but more importantly Mr S’s license would be wiped clean of all existing penalty points. In essence, giving him a fresh start.
