6 Month Disqualification Avoided - Appeal Against Sentence - Exceptional Hardship Successful

Hojol Uddin and Jack Pittam successfully represented Ms Q who was disqualified from driving after an unsuccessful application for hardship had been made at the Magistrates Court by a previous representative. As there were grounds to appeal that refusal Ms Q was eligible to make a renewed application.

Ms Q had already accepted the offence but wished to maintain her appeal against the sentence imposed by the Magistrates’ Court, to the Crown Court, to make her application for exceptional hardship. The application was supported by strong mitigation and documentary evidence which formed the basis of the appeal.

Having heard the mitigation and reviewed the supporting documentation for the same, the Crown Court found that there was exceptional hardship resulting from a disqualification. Importantly the Court recognised the exceptional hardship and did not impose a disqualification from driving.
