Disqualification avoided – Failure to Provide Specimen
Hojol Uddin and Jack Pittam successfully represented Mr K who was at risk of disqualification for failure to provide a specimen when suspected of having been in charge of a vehicle. The client had no points on his license but did have a previous offence for drink driving and therefore was at serious risk of a driving disqualification.
Mr K entered a guilty plea to reserve maximum credit for the sentence which would be imposed against him as he accepted the offence. This was supported by strong mitigation deployed in advance of the Court hearing.
It was advanced in Court that a Band C fine and a 10 penalty point endorsement would be appropriate instead of disqualification. Having heard the mitigation, the Magistrates’ Court agreed and imposed a sentence in line with our submissions. Importantly, Mr K was not disqualified from driving.
