Driving Whilst Disqualified - Drug Driving and No Insurance - Immediate Custodial Sentence Avoided
Hojol Uddin and Elisha Kaur successfully represented an individual who was at risk of a potential immediate custodial sentence and also an approximate disqualification of three years following charges of Drug Driving, Driving whilst Disqualified and Driving without Insurance.
Mr. A confirmed that any custodial sentence and lengthy disqualification would have a devastating impact on his family life due to his wife’s medical condition and young dependent children. Mr A also confirmed his recent medical diagnosis of epilepsy which caused him to have episodes at any given time including on the date of the incident.
Prior to the hearing taking place, JMW Solicitors prepared the individual’s important mitigation for his Plea and Sentencing Hearing. The mitigation was to cover all areas of personal mitigation including medical conditions, family responsibilities and financial commitments.
Mr A then entered a guilty plea to all charges and his mitigation was provided to the Lay Bench to consider before Sentencing. Mr A was then sentenced to a 4 week custodial sentence which was suspended for 18 months and a 40 month driving disqualification for the Drug Driving offence and no separate penalty was imposed for the other matters.
