Taking a Vehicle Without Consent (Theft) and Driving without a license or insurance
Hojol Uddin and Jack Pittam successfully represented an individual at risk of a high-level community order and 12 month ban for taking a vehicle without consent and thereafter driving without a license or insurance. As this individual had previous offences of a similar nature it was highly likely any Judge hearing this case would not give any leniency in the sentence.
Mr K had entered into a guilty plea in order to obtain maximum credit for any sentence which would be imposed against him. This was accompanied by strong mitigation prepared by JMW Solicitors in order to demonstrate the character of this individual and persuade the sitting Judge to impose a lenient sentence.
Mr K had already accrued 8 penalty points against his license and the Judge sought to disqualify him for a period of 6 months which would result in those points remaining on his license even after the disqualification period had lapsed. Fortunately for Mr K the Judge was persuaded to instead imposed 6 penalty points which resulted in a 6 month ban from driving but once served Mr K’s license would be free of penalty points. This result allows Mr K to obtain a license free of points following the conclusion of his ban. Importantly he received a low-level community order.
